Share capital: PLN 10,000.00 fully paid. The company is represented by the management board and authorized representatives in accordance with the data in the National Court Register.

R E G U L A T I O N S




Regulations

I.  DEFINITIONS

The definitions used in these Regulations shall mean as follows:

  1. Regulations – these regulations;
  2. Portal or Service – the internet portal located at the address oceanangels.eu and its subpages;
  3. Account – a part of the Service available to the User after proper registration and login (providing Login and Account password), allowing the use of the Service and the purchase of Services and products offered by the Service as well as modification of personal data and other elements related to the use of the Service;
  4. Login – an individual and unique User name assigned during registration in the Service, or the e-mail address used for registration;
  5. User – an entity/person who has properly registered in the Service (including a person registered for participation in education) and has an active Account;
  6. Visitor – an entity that visits the Service website free of charge, using the Services of the Service in a limited manner appropriate for unregistered persons (non-Users);
  7. Advertiser – a natural person, legal person or organizational unit without legal personality that commissions the Service Provider to place an advertisement of its own product or service in the Service based on separate agreements;
  8. Service – the possibility of using the Service provided by the Service Provider to Users/Entities and Visitors. In particular Services include online courses as well as stationary courses;
  9. Cookies – small text information sent by a WWW server and saved on the user’s device (usually on the hard drive). Default cookie parameters allow only the website that created them to read the information contained in them;
  10. Online Course – a course offered by the Service; Administrator – NAVROCK Sp z o.o., address for service: PN 60-129 Poznań, Sielska 17A, kontakt@oceanangels.eu;
  11. Stationary Course – a course offered by the Service; Administrator – NAVROCK Sp z o.o., address for service: PN 60-129 Poznań, Sielska 17A, kontakt@oceanangels.eu;
  12. Service Provider – NAVROCK Sp z o.o., PN 60-129 Poznań, Sielska 17A, registered in the National Court Register under number 0001073977, NIP: 7792563891, REGON: 527139773;
  13. Shopping Cart – a tool available on the Portal enabling placing an order. Through it the User/Entity may indicate Services, in particular online courses, their quantity and calculate the total order value;
  14. Entity – an entity conducting business activity / school / enterprise applying for organized education for itself / its employee / employees / collaborators as part of the activity conducted by that entity;
  15. ODR Platform – an access point for Consumers and entrepreneurs wishing to resolve disputes out of court established under Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC.

II.  GENERAL PROVISIONS

These Regulations, in accordance with the Act on Providing Services by Electronic Means, specify in particular:

  • the rules for operation and use of the website (portal) located at: www.oceanangels.eu
  • the scope of rights and obligations of its Users / Entities and Visitors
  • Each User, Visitor or Entity using the Service acknowledges and accepts these Regulations, the Privacy Policy and the Cookies Policy available in the Service
  • The Service is an informational and educational internet portal enabling acquisition of additional skills useful in the process of improving qualifications and self-education through the Internet
  • Within the Service the Service Provider enables other entities conducting courses in accordance with applicable law to provide Services using the platform
  • The place of performance of the agreement and provision of Services is the registered office of the Service Provider. The competent court for disputes arising from Services provided by the Service Provider is the court competent for the seat of the Service Provider, except for cases against consumers

III.  LIABILITY OF THE PARTIES

  1. The Service Provider declares that all materials and information contained in the Service are obtained and edited with due diligence to ensure reliability, timeliness and completeness of the Service.
  2. During the selection of materials the Service Provider uses its own materials and materials obtained from external entities in accordance with applicable law.
  3. Any comments regarding materials available in the Service should be sent by e-mail to: kontakt@oceanangels.eu
  4. The Service Provider undertakes to exercise due diligence to ensure continuous and uninterrupted provision of the Service.
  5. The Service Provider undertakes to inform Users/Entities about necessary technical interruptions resulting from the nature of operating the Portal via the Internet.
  6. The Service Provider is not responsible for actions or omissions of Visitors/Users/Entities, including violations of personal rights, trademark rights or copyrights of third parties.
  7. Each User, Visitor or Entity undertakes to comply with Polish and international law, in particular laws concerning personal data protection, protection of personal rights, copyright, industrial property, criminal law and electronic services.
  8. The name of the Service, its concept, graphic design, software and databases are protected by law. The Service Provider does not consent to copying the Service or any of its elements.
  9. The Service Provider and Administrator reserve the right to pursue legal claims against persons violating the law.

IV.  USE OF THE SERVICE

Use of the Service by Visitors, Users and Entities is voluntary.

Before registration Visitors may access information about products and services offered by the Portal.

By registering an account the User provides true personal data and agrees to its processing in accordance with the Privacy Policy and applicable Polish and EU law including GDPR.

The User must protect their login and password and not disclose them to third parties.

The Administrator processes personal data in accordance with GDPR and the Personal Data Protection Act.

The Administrator may suspend or delete a User account in cases of violations of law or these Regulations.

The User may hold only one active account.

V.  PURPOSE OF THE SERVICE AND TERMS OF SERVICE PROVISION

Services provided by the Portal include in particular providing Users and Visitors access to educational resources and enabling participation in online courses.

Services may be free or paid.

Paid services are available only to registered Users or Entities.

Payments are processed via external operators PayU and Stripe.

The Service Provider may introduce discounts, promotions or bonuses at its discretion.

Use of services requires access to the Internet, an e-mail address and a web browser capable of displaying web pages.

VIII.  COMPLAINT PROCEDURE

Users may submit complaints regarding services via e-mail to: kontakt@oceanangels.eu

Complaints will be considered within 14 days.

Consumers may also use out-of-court dispute resolution mechanisms including consumer arbitration courts or the EU ODR platform:

IX.  WITHDRAWAL FROM THE CONTRACT

Consumers may withdraw from the contract within 14 days without giving any reason.

The withdrawal statement may be sent by e-mail to: odstapienia@oceanangels.eu

Payments will be refunded within 14 days.

The right of withdrawal does not apply if the service has been fully performed with the consumer’s consent before the withdrawal deadline.

X.  FINAL PROVISIONS

These Regulations are effective from the moment of publication on the Service website.

The Service Provider reserves the right to amend the Regulations.

In matters not regulated herein, provisions of Polish law shall apply, including the Civil Code and the Act on Providing Services by Electronic Means.

RIGHT OF WITHDRAWAL FROM THE CONTRACT

A consumer may withdraw from the sales contract within 14 days without giving any reason.

To meet the withdrawal deadline it is sufficient to send the statement before the deadline expires.

TRADEMARK AND NAME RIGHTS

Under the agreement of 10.12.2023 the company NavRock Sp z o.o. NIP: 7792563891 is the exclusive legal user authorized to commercially use the name Ocean Angels and Ocean Angels International Sailing within the European Union and worldwide.

The owner of the name, trademark and know-how of Ocean Angels, Ocean Angels Club, Ocean Angels International, Ocean Angels International Sailing and Ocean Angels Exclusive Yacht Club is the Ocean Angels Association headquartered in Poznań, Sielska 17A, 60-129 Poznań, NIP: 7792525264, registered by the President of the City of Poznań.
